These Terms of Service govern your use of the Oath & Honor Designs website and your purchase of products from Oath & Honor Designs. Throughout these Terms, “we,” “us,” and “our” refer to Oath & Honor Designs. “You” and “your” refer to any visitor, customer, or person using our website.

By visiting our website, submitting information, or purchasing a product, you agree to these Terms of Service. Please read them carefully before using the website or placing an order.

1. Online Store Terms

You must be at least 18 years old, or have permission from a parent or legal guardian, to make a purchase from our website.

You may not use our products, website, designs, photographs, written content, or services for any unlawful, fraudulent, misleading, or unauthorized purpose.

You may not attempt to interfere with the operation or security of the website, introduce malicious software, collect information about other users, or use automated systems to copy or extract website content.

2. Products and Services

Oath & Honor Designs creates and sells decals, magnets, personalized products, commemorative items, and related merchandise.

Many of our products are handmade, customized, personalized, or produced after an order is placed. Minor differences in color, placement, sizing, trimming, texture, or appearance may occur between the digital product image and the finished item.

Colors may also appear differently depending on a customer’s screen, printer, lighting, surface, or device settings. These reasonable variations are not considered defects.

We may modify, discontinue, limit, or refuse the sale of any product at any time. Product availability is not guaranteed.

3. Product Measurements and Application

Customers are responsible for reviewing product dimensions and determining whether an item is appropriate for its intended surface, space, or use before purchasing.

Unless expressly stated otherwise, we do not guarantee that decals or adhesive products will adhere properly to every surface. Surface condition, cleanliness, temperature, moisture, paint quality, texture, installation method, and exposure to weather may affect performance.

Oath & Honor Designs is not responsible for damage caused by improper installation, removal, cleaning, storage, handling, or use of a product.

4. Orders and Acceptance

Submitting an order does not guarantee that the order has been accepted. We reserve the right to accept, decline, limit, or cancel an order for reasons including:

Product availability
Pricing or listing errors
Suspected fraud or unauthorized payment activity
Incomplete or inaccurate customer information
Requests involving unlawful, threatening, hateful, defamatory, or infringing content
Production limitations
Violations of these Terms

If we cancel an order after payment has been processed, we will issue the appropriate refund to the original payment method.

5. Custom and Personalized Orders

Customers are responsible for carefully reviewing all names, wording, dates, measurements, colors, photographs, logos, and other customization details submitted with an order.

We are not responsible for spelling errors, incorrect dates, inaccurate information, poor-quality images, or other mistakes supplied or approved by the customer.

Once production begins, a custom or personalized order generally cannot be changed or canceled.

When a proof is provided, the customer is responsible for reviewing and approving it. Approval authorizes us to produce the item as shown. Delays in approving a proof may delay production and delivery.

6. Customer-Submitted Content

By submitting photographs, artwork, logos, names, text, graphics, or other materials for use in a custom product, you represent that:

You own the material or have permission to use it;
Our use of the material will not violate another person’s copyright, trademark, privacy, publicity, or other legal rights; and
The requested product does not violate any applicable law.

You grant Oath & Honor Designs a limited license to reproduce, resize, edit, format, and use the submitted material solely as reasonably necessary to create and fulfill your order.

We may refuse any material or customization request at our discretion.

You agree to be responsible for claims, damages, expenses, or losses resulting from materials you submitted without proper authorization.

7. Intellectual Property

Unless otherwise stated, the original website content, product photographs, written descriptions, layouts, graphics, branding, and original designs created by Oath & Honor Designs are owned by or licensed to Oath & Honor Designs and may be protected by copyright, trademark, and other intellectual-property laws.

You may not copy, reproduce, republish, distribute, sell, modify, or commercially exploit our original content without written permission.

Purchasing a physical product does not transfer ownership of the underlying artwork, design, photograph, digital file, or intellectual-property rights.

Certain names, insignia, seals, logos, emblems, or trademarks displayed on customer-requested or commemorative products may belong to their respective owners. Unless expressly stated, the appearance of such material does not imply endorsement, sponsorship, authorization, or official affiliation with Oath & Honor Designs.

8. Tribute, Commemorative, Police, Fire, Emergency-Service, and Military-Themed Products

Oath & Honor Designs offers decorative, commemorative, memorial, historical, novelty, and tribute products intended to recognize military service, law-enforcement service, firefighters, emergency medical personnel, veterans, first responders, public-service organizations, and related communities.

Unless a product listing expressly states otherwise, these products:

Are not official police, fire, emergency-service, government, or military equipment;
Are not uniforms, badges, credentials, identification cards, insignia of authority, duty equipment, protective equipment, vehicle equipment, or government-issued property;
Are not intended to represent that the purchaser is a police officer, firefighter, emergency responder, military member, government employee, or authorized representative of any organization;
Are not intended for use in gaining access, exercising authority, impersonating another person, misleading the public, or performing official duties; and
Are sold solely as decorative, commemorative, collectible, memorial, novelty, or tribute merchandise.

Our products are not designed, marketed, or sold as counterfeit merchandise. Oath & Honor Designs does not knowingly represent any item as authentic, officially issued, officially licensed, endorsed, sponsored, approved, or manufactured by a police department, fire department, emergency-service agency, military branch, government entity, veteran organization, business, trademark owner, or other rights holder unless such authorization has been expressly obtained and identified in the applicable product listing.

The use of a department name, military branch, occupational title, historical reference, color scheme, symbol, tribute wording, or similar subject matter is intended to identify the theme or community being honored. Such use does not, by itself, indicate sponsorship, endorsement, affiliation, licensing, or official status.

Customers understand and agree that these products are purchased as tribute, commemorative, decorative, memorial, novelty, or collectible items and not as official equipment or proof of authority, employment, membership, certification, rank, service, or affiliation.

Customers may not use a product purchased from Oath & Honor Designs:

To impersonate a police officer, military member, first responder, government employee, or other official;
To falsely suggest governmental, departmental, military, organizational, or commercial authorization;
To deceive, intimidate, mislead, or obtain a benefit through a false appearance of authority;
As a substitute for required safety, identification, uniform, vehicle, or duty equipment; or
For any unlawful, fraudulent, or unauthorized purpose.

Organizations, online marketplaces, payment processors, fulfillment providers, and other entities through which our products are displayed or sold are likewise advised that our products are offered and described as tribute or commemorative merchandise rather than official equipment or officially issued property, except where a listing expressly and accurately states otherwise.

We make reasonable efforts to avoid infringing copyrights, trademarks, protected insignia, designs, and other intellectual-property rights. We may modify, decline, discontinue, or remove any design or product when we believe authorization may be required, when a rights holder raises a legitimate concern, or when a sales platform prohibits the item.

A disclaimer, tribute designation, or statement of non-affiliation does not create permission to use intellectual property owned by another party. Nothing in this section should be interpreted as claiming ownership of third-party names, logos, seals, patches, insignia, emblems, slogans, or other protected material. All such rights remain with their respective owners.

9. Pricing and Payment

Prices are displayed in United States dollars unless otherwise stated.

We reserve the right to change prices at any time. A price change will not affect an order that has already been accepted, except where a clear pricing or technical error occurred.

Applicable taxes, shipping charges, and other required charges will be displayed during checkout before payment is submitted.

You agree to provide current, complete, and accurate billing, payment, contact, and shipping information.

We may use third-party payment processors. Oath & Honor Designs does not directly control how those processors collect, store, or process your payment information.

10. Shipping and Delivery

Processing and delivery estimates are provided as estimates and are not guaranteed arrival dates.

Oath & Honor Designs is not responsible for delays caused by postal carriers, weather, natural disasters, transportation interruptions, labor disputes, holidays, incorrect addresses, security inspections, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address. Additional charges may apply when an order must be reproduced or reshipped because the customer supplied an incorrect or incomplete address.

An order marked as delivered by the shipping carrier will generally be considered delivered. Customers should contact the carrier and Oath & Honor Designs promptly when a package is missing, delayed, or believed to have been misdelivered.

Any rights a customer may have under applicable law concerning delayed or unshipped orders remain unaffected.

11. Returns, Refunds, and Replacements

Due to the custom, personalized, handmade, and made-to-order nature of our products, all sales are final unless otherwise required by law.

We do not generally accept returns, exchanges, or cancellations after production begins.

However, we want customers to be satisfied with their purchases. If an item arrives damaged, defective, or contains an error caused by Oath & Honor Designs, the customer must contact us within seven days of delivery and provide clear photographs of the item and packaging.

After reviewing the circumstances, we may approve a replacement. An approved replacement may be produced without an additional product charge. Depending on the circumstances, the customer may be responsible for the cost of shipping the replacement.

12. Promotions and Discount Codes

Promotions, discount codes, and special offers may be subject to separate conditions and expiration dates.

Unless otherwise stated:

Discounts cannot be combined;
Discount codes have no cash value;
Discounts cannot be applied retroactively;
Promotions may be modified or discontinued; and
Orders involving misuse of a promotion may be canceled.

13. Reviews and Customer Feedback

You may submit honest reviews, comments, photographs, suggestions, or other feedback concerning our products and services.

You remain responsible for content you submit. Feedback must not be unlawful, threatening, harassing, defamatory, fraudulent, obscene, or infringing.

We may display, reproduce, or share voluntarily submitted reviews and product-related photographs for legitimate business and promotional purposes, subject to applicable law and our Privacy Policy.

Nothing in these Terms prohibits or penalizes a customer for providing an honest review or reporting a concern to a government agency, law-enforcement authority, payment provider, or consumer-protection organization.

14. Third-Party Services and Links

Our website may use or contain links to services operated by third parties, including Shopify, payment processors, shipping carriers, social-media platforms, and marketplace services.

We do not control and are not responsible for the availability, content, security, accuracy, policies, or practices of third-party websites or services.

Use of a third-party service may be governed by that provider’s separate terms and privacy policy.

15. Prohibited Uses

You may not use our website or services to:

Violate any law or regulation;
Infringe intellectual-property or privacy rights;
Submit fraudulent payment information;
Impersonate another person or organization;
Transmit malicious code;
Harass, threaten, defame, or discriminate against others;
Scrape, copy, or commercially exploit website content;
Circumvent website security or purchase limitations; or
Request products that we reasonably believe are unlawful or unauthorized.

We may terminate or restrict access to the website for violations of these Terms.

16. Disclaimer of Warranties

To the fullest extent permitted by law, the website and products are provided on an “as available” and “as is” basis, except for any express written promises contained in a product listing or required by law.

We do not guarantee that the website will always be uninterrupted, secure, or error-free.

We do not warrant that every product will be suitable for every customer, surface, environment, application, or intended use.

Nothing in these Terms excludes any warranty or consumer right that cannot legally be excluded.

17. Limitation of Liability

To the fullest extent permitted by law, Oath & Honor Designs will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of our website or products.

Our total liability for a claim involving a purchased product will not exceed the amount the customer paid for the product giving rise to the claim, except where a greater remedy is required by law.

This limitation does not apply to liability that cannot legally be limited or excluded.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Oath & Honor Designs from claims, damages, losses, liabilities, and reasonable expenses arising from:

Your misuse of the website or a product;
Your violation of these Terms;
Content or materials you submitted;
Your infringement of another person’s rights; or
Your violation of applicable law.

19. Privacy

Our collection and use of personal information are governed by our Privacy Policy.

By using the website, you acknowledge that information may be processed by Shopify and other service providers necessary to operate the store, process payments, fulfill orders, prevent fraud, and provide customer service.

20. Governing Law

These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law principles.

To the extent permitted by law, legal proceedings involving these Terms or a purchase from Oath & Honor Designs will be brought in an appropriate court located in St. Lucie County, Florida.

Nothing in this section limits any consumer right concerning jurisdiction or venue that cannot legally be waived.

21. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

22. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.

23. Entire Agreement

These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and any product-specific terms, constitute the entire agreement between you and Oath & Honor Designs concerning use of the website and purchases from the store.

24. Changes to These Terms

We may revise these Terms periodically by posting an updated version on the website. Changes become effective on the effective date displayed at the top of the revised Terms.

Your continued use of the website after revised Terms become effective constitutes acceptance of those revised Terms.

Changes will not retroactively alter an order that was already accepted unless required by law or agreed to by the customer.
