By accessing our website, communicating with us, submitting a custom request, or purchasing a product, you acknowledge and agree to this Legal Notice together with our Terms of Service, Privacy Policy, Shipping Policy, and Return and Refund Policy.

Oath & Honor Designs is an independently operated online design and merchandise business located in Florida.

For privacy and security reasons, the owner’s personal name, residential address, personal telephone number, and private email address are not published on this website.

Oath & Honor Designs is an independent business.

Unless expressly and accurately stated in a specific product listing, Oath & Honor Designs is not affiliated with, employed by, sponsored by, endorsed by, approved by, licensed by, or acting on behalf of:

Any police department or law-enforcement agency;
Any fire department or emergency medical service;
Any military branch or military unit;
Any federal, state, county, municipal, foreign, or tribal government;

Oath & Honor Designs offers decorative, commemorative, memorial, historical, novelty, collectible, and tribute merchandise.

Our tribute products are intended to honor military personnel, veterans, law-enforcement officers, firefighters, emergency medical personnel, first responders, public servants, agencies, organizations, historical events, and related communities.

Unless expressly stated otherwise, these products are unofficial tribute items and are not represented as authentic, officially issued, officially licensed, government-manufactured, department-issued, or organization-approved merchandise.

The terms “tribute,” “commemorative,” “memorial,” “decorative,” “collectible,” “novelty,” and “unofficial” describe the intended purpose of the product. These descriptions do not grant Oath & Honor Designs permission to use intellectual property owned by another person or organization.

5. Not Police, Military, Fire, or Emergency Equipment

Products sold by Oath & Honor Designs are not intended to function as:

Police or law-enforcement equipment;
Military equipment;
Firefighting or emergency-response equipment;
Government credentials;
Official identification;
Badges or insignia of legal authority;
Uniform components;
Protective or safety equipment;
Emergency vehicle equipment;
Department-issued property;
Proof of rank, employment, certification, membership, or service; or
Authorization to enter restricted areas or exercise official authority.

Products may not be used to impersonate an officer, military member, firefighter, first responder, public employee, government representative, or member of an organization.

Products may not be displayed or used in a manner intended to deceive, intimidate, mislead, obtain access, receive preferential treatment, or create a false appearance of authority.

6. No Counterfeit Representation

Oath & Honor Designs does not knowingly manufacture, advertise, or sell products as counterfeit, authentic, officially issued, officially licensed, officially approved, or authorized merchandise when they are not.

We do not knowingly claim that an unofficial tribute product was manufactured, issued, approved, or endorsed by the organization, agency, department, military branch, business, or rights holder referenced by the design.

Product descriptions and photographs should be considered together with all disclaimers and notices contained in the applicable listing.

The appearance of a third-party name, title, term, symbol, insignia, color combination, or reference does not mean that the product is official merchandise.

7. Intellectual-Property Ownership

All trademarks, service marks, trade names, logos, seals, badges, emblems, patches, insignia, slogans, photographs, artwork, characters, and other intellectual property belonging to third parties remain the property of their respective owners.

Oath & Honor Designs does not claim ownership of third-party intellectual property merely because it appears in a product request, listing, design, photograph, description, or tribute item.

Original photographs, written descriptions, branding, layouts, graphics, and original design elements created by Oath & Honor Designs may be protected by copyright, trademark, or other applicable law.

Purchasing a physical product does not transfer ownership of the underlying artwork, design files, photographs, production files, templates, intellectual property, or reproduction rights.

Customers may not copy, scan, trace, reproduce, resell, redistribute, upload, manufacture from, or commercially exploit our original artwork or product photographs without written permission.

8. Tribute and Disclaimer Limitations

A disclaimer of affiliation does not itself authorize the use of protected intellectual property.

A tribute designation does not prevent a trademark, copyright, publicity-right, licensing, marketplace-policy, or other claim.

Oath & Honor Designs reserves the right to modify, decline, suspend, discontinue, or remove any product or design when:

Authorization may be required;
A rights holder raises a legitimate concern;
A marketplace or service provider restricts the item;
The product may create confusion concerning source or affiliation;
The product could facilitate impersonation or misuse;
Continued sale presents an unreasonable legal or business risk; or
We otherwise determine that removal is appropriate.

Removal of a product does not constitute an admission of infringement, counterfeiting, wrongdoing, liability, or prior knowledge.

9. Customer-Submitted Materials

Customers requesting personalized or custom products may submit names, wording, photographs, artwork, logos, insignia, emblems, or other materials.

By submitting material, the customer represents and warrants that:

The customer owns the material or has permission to use it;
The requested use does not violate another party’s copyright, trademark, privacy, publicity, contractual, or other rights;
The material is not unlawful, fraudulent, defamatory, threatening, hateful, obscene, or misleading;
The product will not be used for impersonation, deception, intimidation, unauthorized access, or another unlawful purpose; and
The information supplied is accurate.

The customer grants Oath & Honor Designs a limited license to reproduce, resize, crop, format, edit, print, manufacture, and otherwise use the submitted material solely as reasonably necessary to review, produce, fulfill, and document the order.

We may refuse any custom request at our discretion.

The customer agrees to be responsible for claims, losses, expenses, and damages resulting from material submitted without proper authorization, to the extent permitted by law.

10. Rights-Holder Concerns

Oath & Honor Designs respects legitimate intellectual-property rights.

A trademark owner, copyright owner, agency, department, organization, authorized licensing representative, or other rights holder may submit a good-faith concern to:

The name and contact information of the complaining party;
Identification of the rights holder;
A description of the protected material;
Identification or link to the product at issue;
An explanation of the claimed violation;
Evidence of ownership or authority to act for the rights holder;

We may request additional documentation before acting.

We reserve the right to investigate, modify, restrict, temporarily disable, or remove disputed content while reviewing a complaint.

Taking voluntary corrective action does not constitute an admission of infringement, counterfeiting, liability, or wrongdoing.

Fraudulent, knowingly false, or materially misleading complaints may be rejected and may be reported to the appropriate platform or authority.

11. Marketplace, Hosting, and Service Providers

Our website and business may rely on third-party providers for hosting, ecommerce functions, payment processing, advertising, communications, analytics, shipping, domain services, and marketplace access.

These providers are independent third parties and are not partners, agents, employees, joint venturers, representatives, or guarantors of Oath & Honor Designs.

Our use of a third-party platform does not mean that the platform endorses, sponsors, approves, authenticates, licenses, or guarantees our products.

Likewise, Oath & Honor Designs does not control or guarantee:

The uninterrupted availability of any platform;
Search placement or visibility;
Marketplace approval;
Advertising approval;
Payment authorization;
Account eligibility;
Delivery performance;
Data transmission;
Third-party security;
Third-party policy interpretation; or
Continued access to a third-party service.

We remain subject to applicable provider agreements and policies. A provider may review, restrict, hide, remove, suspend, or terminate content or services under its own rules.

Nothing in this Legal Notice requires a hosting company, marketplace, payment provider, search engine, carrier, or other third party to continue providing services to Oath & Honor Designs.

12. No Third-Party Beneficiaries

Except where applicable law provides otherwise, this Legal Notice does not create enforceable rights in favor of a person or entity that is not a party to a transaction with Oath & Honor Designs.

References to third parties are provided for identification, disclosure, and clarification and do not make those parties beneficiaries of any agreement between Oath & Honor Designs and a customer.

13. Product Images and Variations

Product photographs, digital mockups, proofs, and screen images are intended to provide a reasonable representation of the product.

Actual products may vary slightly because of:

Monitor or device settings;
Lighting;
Printing methods;
Material texture;
Surface color;
Hand placement;
Trimming;
Cutting;
Lamination;
Manufacturing tolerances; or
Availability of materials.

Reasonable variations do not necessarily constitute defects, false advertising, or grounds for a refund.

Measurements are approximate unless expressly stated otherwise.

14. Product Use and Installation

Customers are responsible for determining whether a product is appropriate for the intended surface, location, environment, and use.

Adhesive performance may be affected by surface texture, paint condition, coatings, wax, dirt, moisture, temperature, sunlight, weather, installation method, and age.

Customers should clean and test surfaces before installation.

Oath & Honor Designs is not responsible for damage to paint, glass, walls, vehicles, equipment, furniture, electronics, or other property caused by installation, removal, cleaning, storage, misuse, or environmental conditions, except where liability cannot legally be excluded.

Our products are not safety devices and should not be relied upon to prevent injury, damage, loss, or unauthorized access.

15. Personal Responsibility and Prohibited Use

Customers are responsible for using products lawfully and appropriately.

Products may not be used:

To impersonate another person;
To represent nonexistent authority;
To create false identification;
To mislead the public;
To gain unauthorized entry;
To interfere with law enforcement or emergency personnel;
To violate uniform, badge, credential, vehicle-marking, or impersonation laws;
To infringe intellectual-property rights;
To harass, threaten, intimidate, or defame another person;
To promote unlawful discrimination or violence; or
For any fraudulent or unlawful purpose.

We may refuse or cancel orders associated with suspected misuse.

16. Pricing, Availability, and Errors

Prices, discounts, descriptions, dimensions, photographs, inventory levels, and availability may change without notice.

We may correct typographical, technical, pricing, shipping, inventory, or listing errors.

We reserve the right to reject or cancel an order affected by an obvious error. If payment has already been collected for a canceled order, the appropriate refund will be issued to the original payment method.

17. Consumer Rights

Nothing in this Legal Notice is intended to eliminate, restrict, or waive a consumer right, warranty, remedy, refund right, chargeback right, or other protection that cannot legally be excluded.

Where this Legal Notice conflicts with a mandatory law, the mandatory law controls.

Customers remain responsible for reviewing product descriptions, measurements, customization information, shipping estimates, and store policies before purchasing.

18. Disclaimer of Warranties

To the fullest extent permitted by law, the website, its content, and products are provided on an “as is” and “as available” basis, subject to any express product representation and any warranty that cannot legally be excluded.

We do not guarantee that:

The website will always be uninterrupted or error-free;
Every product will be suitable for every use or surface;
Product colors will appear identical on every screen;
Third-party services will remain available;
A product will be accepted by a marketplace, organization, department, employer, agency, or other third party; or
A commemorative product will retain value as a collectible.

19. Limitation of Liability

To the fullest extent permitted by law, Oath & Honor Designs will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from:

Use, installation, removal, display, or misuse of a product;
Reliance on website information;

Unauthorized customer-submitted material;

A customer’s unlawful or unauthorized conduct.

To the fullest extent permitted by law, our total liability arising from a product or transaction will not exceed the amount paid to Oath & Honor Designs for the product giving rise to the claim.

Nothing in this section excludes liability that cannot legally be limited.

20. Indemnification

To the extent permitted by law, customers agree to indemnify, defend, and hold harmless Oath & Honor Designs from claims, demands, damages, judgments, liabilities, penalties, and reasonable expenses arising from:

Material submitted by the customer;
The customer’s unauthorized use of third-party intellectual property;
The customer’s misuse of a product;
Impersonation or misleading use;
Violation of these policies;
Violation of law; or
Infringement of another person’s rights.

This provision does not apply to the extent a claim was caused solely by conduct for which Oath & Honor Designs cannot legally disclaim responsibility.

21. No Admission

The modification, suspension, refund, replacement, settlement, discontinuation, or removal of a product does not constitute an admission that the product was defective, unlawful, counterfeit, infringing, misleading, unauthorized, or otherwise improper.

Customer-service accommodations may be provided as a business courtesy without creating a continuing obligation or precedent.

22. Enforcement and Severability

We may enforce this Legal Notice at our discretion. Failure to enforce a provision on one occasion does not waive the right to enforce it later.

If a provision is found invalid or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.

23. Governing Law

This Legal Notice is governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law rules.

To the extent legally permitted, claims involving this website or a purchase from Oath & Honor Designs will be brought in an appropriate court located in St. Lucie County, Florida.

Nothing in this section overrides a jurisdiction, venue, or consumer right that cannot legally be waived.

Changes apply from the effective date shown in the revised notice. Changes will not retroactively alter an accepted order unless required by law or agreed to by the customer.
